Therefore, Moghbel Ltd invites you to read the following terms to ensure clarification exists between parties, from the very start.

1.     Definition of our terminology as used within this document:

1.1.     'You' or 'Client,' is a person, persons, business or organization using any of the services provided by Moghbel Ltd.

1.2.     'We', 'us' or ‘our’, means Moghbel Ltd or www.moghbel.co.uk interchangeably.

1.3.     'Domain' is the website address as specified by the client.

1.4.     Hosting' is a yearly cost to keep a client’s website activated online.

1.5.     'Content' is both text and images that the client requires on the website.

1.6.     ‘Content writing package’, is a service provided by Moghbel Ltd creating texts and if required logos for clients.

1.7.     ‘Quotes’, is our estimated measure of costs in relation to the service(s) you seek at a specific time.

1.8.     ‘Service’ is any work undertaken or provided by Moghbel Ltd for the client on their request and as described in our confirmation order email to that client.

1.9.     ‘Graphic design’ any images, texts or both images and texts purchased by You using our service.

1.10.     ‘Gift’ or ‘Gifted’, any services provided by us for free.

1.11.     ‘Deposit’, any amount less of the total sum of the price of a service provided to you by Moghbel Ltd.

2.     Terms of use:

2.1.     By accessing the website at www.moghbel.co.uk, you are agreeing to be bound by these terms of service, all applicable laws, and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

2.1.1.     The contract between Moghbel Ltd and the client will be on these conditions, to the exclusion of all other terms and conditions. Any variations to these conditions shall have no effect unless agreed in writing.

2.2.     The services to be carried out shall be as set out in the Moghbel Ltd invoice which can be found attached to the confirmation order email.

2.3.     Moghbel Ltd will only carry out services for clients who are 18 years of age or above.

2.4.     By using our services or accessing www.moghbel.co.uk, you are agreeing to be bound by these terms and conditions available on this page.

2.5.     You will not copy, edit, forge, use our logo, or other proprietary information, without the written consent of Moghbel Ltd.

2.6.     Should a client choose to leave the hosting contract prior to the agreed date (usually 12 months from the start of the annual hosting contract), it must be noted that the content such as text and images on the said website will be offered for a cost of no less than £250, varying on the degree of work undertaken and subject to increase of costs as necessary.

2.6.1.     Kindly note, that the CCS, font and JS files (all styling) will be removed unless the willing party makes necessary payment to avoid removal of said content.

2.7.     Our services or/and hosting period will end 3o days after we receive your termination fees.

2.8.     Moghbel Ltd will show no tolerance towards hidden Terms and Conditions on the client's side. We aim to clarify our Terms and Conditions by making them easily available to ensure our professional relationship remains intact. Therefore, we would appreciate your effort likewise, by sending your FULL TERMS AND CONDITIONS to info@moghbel.co.uk prior to the working relationship between parties.

2.9.     Any mid-term amendment to the client's Terms and Conditions should be sent to info@moghbel.co.uk as soon as possible

2.9.1.     If and when such amendments of the said Terms and Conditions are provided, Moghbel Ltd will have the right to approve or disapprove the new Terms and Conditions.

2.9.2.     Please note, Moghbel Ltd has the right to terminate any existing contract it is part of.

2.9.3.     Moghbel Ltd has the right to replace the displayed website with "we will be back soon", to which further fees can apply.

3.     Disclaimer

3.1.     The materials on Moghbel Ltd's website are provided on an 'as is' basis. Moghbel Ltd makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

3.2.     Further to section 3.1, Moghbel Ltd does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

4.     Liability:

4.1.     In no event will any of us be liable for any damages (including, without limitation, incidental or consequential damages, lost profits, or any physical or non-physical damages resulting from lost data or business interruption) arising out of or in connection with these terms or from use of our services, or from any communications or interactions with Moghbel Ltd.

5.     Links:

5.1.     Moghbel Ltd has not reviewed all the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Moghbel Ltd of the site. Use of any such linked website is at the user's own risk.

6.     Quotes:

6.1.     We provide quotes to clients when requested in relation to the service(s) they require by Moghbel Ltd. Each quote given to the client is valid for a total period of 48-hours from the moment the email was sent to the client from our business emails.

6.1.1.     After 48-hours we reserve the right to modify the quotes pricing or cancel our pricing obligations for the requested service.

7.     Website and Content:

7.1.     Moghbel Ltd reserves the rights to use images of the Website and graphic design in any online/offline portfolio, and place the 'Moghbel logo/text' and a hyperlink back to http://www.moghbel.co.uk on any design work carried out - Unless otherwise agreed prior to the project commencing.

7.2.     The Client shall ensure that the Client Materials and any materials uploaded to the Website do not infringe any applicable laws, regulations or third party rights.

7.3.     The Client acknowledges that Moghbel Ltd has no control over any content placed on the Website by any website visitors and does not purport to monitor the content of the Website. Moghbel Ltd reserves the right to remove content from the Website where it reasonably suspects such content is Inappropriate Content.

7.4.     Moghbel Ltd may include the statement "Designed and developed by Moghbel Ltd" on the home page of the Website.

8.     Privacy policy:

8.1.     You agree to allow us to store and use personal information you provide us with accordance to relevant privacy policy laws of England and Wales.

9.     Governing Law:

9.1.     These terms and conditions are governed by and construed in accordance with the laws of England and Wales you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

10.     Support:

10.1.     While a website is hosted with Moghbel Ltd, we shall be available between the hours of 9.00am and 5.00pm Monday – Friday. This excludes all bank holidays. Within a reasonable time period we will look to fix any issues with the website which are not due to a customer’s doing free of charge.

11.     Complaints:

11.1.     All complaints must be sent to customerservices@moghbel.co.uk should you wish your concerns be considered by us.

11.2.     We will investigate any complaints using our internal procedures within 28-working days, unless expressed to you via email that it will take longer. You agree that we have no obligation to share our internal procedures with you.

11.2.1.     We reserve the right to make any judgement ourselves based on your complaints and our judgement will be final with no appeals from you. This will not affect your statutory right to proceed with your complaint outside of Moghbel Ltd should you feel we have not dealt with your case appropriately.

12.     Changes to terms:

12.1.     Moghbel Ltd may revise these terms of service for its website at any time without notice. By using this website, you are agreeing to be bound by the then current version of these terms of service.
